Európske občianstvo v kontexte Európskej ústavnej zmluvy a diskusií o jej ďalšom osude

Abstract

Súčasťou odborných a politických diskusií, ktoré sprevádzali zmeny v spôsobe fungovania EÚ vyvolané jej rozširovaním, bola aj problematika európskeho občianstva. Diskusie o európskom občianstve naštartovalo vedomie, že existujú vážne deficity v informovanosti občanov o Európskej únii a ich participácia na politickom živote EÚ je nedostatočná. Autor v článku sleduje genézu tejto diskusie a analyzuje, aké miesto má rozvíjanie európskeho občianstva v európskom projekte a za akých predpokladov sa európske občianstvo môže posilňovať. Podrobne analyzuje úpravu európskeho občianstva v platných európskych zmluvách a ďalších európskych normách, najmä však hlavné zámery pokusu o posilnenie európskeho občianstva v Zmluve o ústave pre Európu. Prvoradú pozornosť venuje pritom Charte základných práv EÚ a úlohe európskeho občianstva v posilňovaní EÚ ako globálneho aktéra v medzinárodných vzťahoch. Autor ukazuje, že otázky formovania európskeho občianstva nemajú iba právny a inštitucionálny rozmer, ale aj rozmer sociálny, kultúrny a svetonázorový. Posilňovanie európskeho občianstva je podľa jeho názoru nevyhnutným predpokladom pre posilňovanie európskej identity.
