Spillover V Agende Základných Práv Eú: Pôsobnosť, Expanzívnosť A Následky

Abstract

Článok sa zaoberá vývojom ľudsko-právnej agendy v Európskej únii (EÚ), dynamikou zmien v chápaní tejto agendy a prierezovým charakterom ľudských práv, ktoré sa prostredníctvom neofunkcionalistického spillovera a aktivizmu Súdneho dvora EÚ stávajú dôležitou súčasťou vývoja a uplatňovania jednotlivých politík Únie. Ďalej je rozoberaná rozpínavosť ľudsko-právnych rozpráv, vplyv politickej korektnosti na formovanie ľudsko-právnej agendy a jej postupné presúvanie z národno-štátnej úrovne na nadnárodnú európsku úroveň.
