Speeding up the process of harmonising European insolvency law to strengthen financial integration

Abstract

For some thirty years, Europeans have been striving to harmonise their national insolvency law regimes. This movement is now gathering momentum, to accompany the construction of the Capital Markets Union. The aim is to reduce costs, better reallocate resources to more efficient or innovative companies, encourage cross border investment and contribute to financial stability. This recent progress can already be seen in major international rankings (according to the OECD ranking, 16 EU Member States are among the 20 countries with the most advanced insolvency regimes, compared with 11 in 2016). This movement should continue with the new proposal for a directive, which was published by the European Commission in December 2022, and the exploration of new avenues for harmonisation, which is always desirable. Depuis une trentaine d’années, les Européens s’efforcent d’harmoniser leurs régimes nationaux du droit de l’insolvabilité. Ce mouvement s’accélère aujourd’hui, afin d’accompagner la construction de l’Union des marchés de capitaux. Il s’agit tout à la fois de réduire les coûts, de mieux réallouer les ressources vers des entreprises plus performantes ou innovantes, de favoriser les investissements transfrontaliers et de concourir à la stabilité financière. Ces progrès récents sont d’ores et déjà perceptibles dans les classements internationaux faisant référence (16 États membres de l’Union européenne figurent parmi les 20 pays ayant les régimes d’insolvabilité les plus avancés selon le classement de l’OCDE, contre 11 en 2016). Le mouvement devrait se poursuivre avec la nouvelle proposition de directive, publiée par la Commission européenne en décembre 2022, et l’exploration, toujours souhaitable, de nouvelles pistes d’harmonisation.
