Abstract

Der Compartment Transfer als innovative Technologie zur Grundwassersanierung kann eine deutliche Kostensenkung bei der Sanierung kontaminierter Grundwasserkörper bewirken. Innovative Technologien können aber auch Gefahren und Risiken für Mensch und Umwelt mit sich bringen. Ihrem Schutz dienen umweltrechtliche Vorgaben, die bei der Entwicklung neuer Verfahren wichtige Rahmenbedingungen oder verbindliche Grenzen setzten. Ziel der rechtlichen Untersuchung war es, die Rigidität und Flexibilität des Ordnungsrechts im Hinblick auf neuartige Sanierungsverfahren herauszuarbeiten sowie für die Projektpartner eine Entscheidungshilfe bei der Entwicklung und Kalibrierung ihrer Verfahren zu geben. Schwerpunkt der rechtlichen Untersuchung ist die formelle und materielle Zulässigkeit der einzelnen Sanierungsverfahren des Compartment Transfers, soweit nach den erfolgten technologischen Konkretisierungen eine Beurteilung möglich ist.
