Ein bisschen Freiheit: Was die Verabschiedung des Freedom Act durch den US-Kongress bedeutet

Abstract

Mit Inkrafttreten des sogenannten USA Freedom Act werden die gesetzlich festgelegten Befugnisse der US-Nachrichtendienste zum Sammeln von Daten erstmals seit dem 11. September 2001 eingeschränkt. Über zwei Jahre nachdem Edward Snowden die Überwachungspraxis der National Security Agency (NSA) publik machte, hat der Kongress eine Reform beschlossen. Der Beschluss zeigt, dass die Entscheidungsträgerinnen und Entscheidungsträger in den USA bei der Bewertung bestimmter nachrichtendienstlicher Programme zu anderen Ergebnissen kommen, wenn sie diese vor der Öffentlichkeit rechtfertigen müssen. Gleichzeitig machen der lange Vorlauf der Gesetzesänderung und die begrenzte Reichweite der Reform deutlich, wie hoch die Hürden dafür sind, dass einmal beschlossene Einschränkungen von Bürgerrechten wieder zurückgenommen werden, die für den Kampf gegen den Terrorismus notwendig erschienen.
