UN-Friedenssicherung zwischen den Fronten: Der Streit um den Internationalen Strafgerichtshof

Abstract

Am 21. Juni 2002 kam es im UN-Sicherheitsrat (SR) zum Eklat. Die USA stimmten einer Verlängerung des UN-Mandats für die Friedensmission in Bosnien und Herzegowina (UNMIBH) nur bis zum 30. Juni 2002 zu. Sie kündigten ferner an, daß sie alle anstehenden Verlängerungen von Mandaten für UN-Einsätze mit ihrem Veto blockieren würden, wenn nicht Staatsangehörigen aus Ländern, die keine Vertragsstaaten des Römischen Statuts für den Internationalen Strafgerichtshof (IStGH) sind, bei UN-Einsätzen eine grundsätzliche Immunität vor dem IStGH gewährt würde. Die Europäer waren brüskiert. Nicht nur die für sie so bedeutsame Friedensmission auf dem Balkan, sondern auch das Instrument der UN-Friedenssicherung stand auf dem Spiel. Am 12. Juli 2002 wurde durch Bezugnahme auf Artikel 16 des Römischen Statuts in SR-Resolution 1422 ein Konsens erzielt. Wie tragfähig ist er? Was hatte die Amerikaner zu solchen Schritten bewogen?
