Insolvenz des Unternehmens: Welche Rechte und Pflichten hat der Aufsichtsrat in der Unternehmenskrise? Arbeitshilfen für Aufsichtsräte

Abstract

Immer wieder geraten Gesellschaften in eine wirtschaftliche Krise. In diesem Fall ist nicht nur die Geschäftsleitung, sondern auch der Aufsichtsrat als beratendes und mitentscheidendes Organ des Unternehmens in der Verantwortung. In der Krise muss der Aufsichtsrat nicht nur seine Instrumente zur Kontrolle verstärkt nutzen. Dabei muss er im Fall der Fälle auch über die Grundlagen des Insolvenzrechts Bescheid wissen. Die vorliegende Arbeitshilfe will Aufsichtsräten einen Überblick über das Insolvenzverfahren geben.
