Nichttarifäre Handelsschranken im öffentlichen Auftragswesen der Bundesrepublik Deutschland

Abstract

Im Zuge der Vergabe öffentlicher Aufträge können Hemmnisse für den internationalen Handel dann eintreten, wenn einheimische Anbieter bevorzugt werden. Sind nämlich leistungsfähigere ausländische Lieferanten vorhanden und bereit, zu einem günstigeren Preis gleichwertige Produkte (bzw. andere Leistungen) zu liefern, dann wird infolge der bevorzugten Heranziehung heimischer Anbieter ein vorteilhaftes internationales Geschäft verhindert. Zwar wird nicht wie im Falle der mengenmäßigen Beschränkungen der Import ausländischer Erzeugnisse ausdrücklich, direkt und in bestimmter Höhe begrenzt. Das Verhalten des öffentlichen Auftraggebers wirkt sich aber indirekt als Einfuhrbeschränkung aus. Als öffentliche Auftraggeber werden üblicherweise der Staat und die Gebietskörperschaften (in der Bundesrepublik also die Länder, Kreise und Gemeinden) sowie die Körperschaften, Anstalten, Stiftungen und Verbände öffentlichen Rechts angesehen. Dazu gehören auch so gewichtige Nachfrager wie die Bundesbahn und die Bundespost, so daß sich ein sehr beachtliches Auftragsvolumen ergibt.
