Bremst EU-Recht die sozial-ökologische Transformation aus? Eine juristische Bewertung

Abstract

Die USA haben ein riesiges Investitionspaket für den Klimaschutz geschnürt, das aber protektionistisch an den Grundsatz "Made in USA" geknüpft ist. So stellt sich die Frage, inwieweit die EU umweltfreundliche Technik und Produktion subventionieren sollten und inwieweit sie das dürfen. Konkret: Lassen die strengen Beihilferegeln in den EU-Verträgen eine gezielte finanzielle Förderung einer ökologischen Produktionsweise zu? Die Stellungnahme zeigt, dass die Spielräume größer sind als gedacht, weil vom Beihilfeverbot Ausnahmen existieren, die von der Kommission im Laufe der Zeit beständig erweitert wurden.
