Das neue Urheberrecht - Schranke der Wissensgesellschaft im digitalen Zeitalter

Abstract

Das Urheberrecht regelt in unserer Gesellschaft, wem Produkte besonderer geistiger Leistungen gehören, nach welchen Zeiträumen Eigentumsrechte erlöschen und wie geistiges Eigentum verwertet und genutzt werden kann. Angestoßen durch EU-Richtlinien wird das Urheberrecht zurzeit reformiert. Wichtige Punkte sind der Zugang der Gesellschaft zu Geistesprodukten und die Möglichkeiten, sich Privatkopien von gedruckten oder digitalisierten Produkten anzufertigen.Alles läuft darauf hinaus, dass sich ein sehr umfassendes Verbot der Privatkopie durchsetzt und damit vielen Menschen im Privatbereich der Zugang zur Wissensgesellschaft verwehrt wird. Ebenso schwer wiegt, dass es den öffentlichen Sektoren Erziehung, Schule und Hochschule versagt werden wird, mit Kopien von Wissensprodukten zu arbeiten. So werden auf dem Weg in die Wissensgesellschaft - elementarer Punkt für ein hoch entwickeltes Land wie unseres - hohe Barrieren errichtet. Es droht die einseitige Kommerzialisierung von Wissensprodukten sowie die Benachteiligung des geistigen Urhebers.Die Veröffentlichung von Jeannette Hofmann (WZB Berlin) analysiert die Hintergründe.
