Betriebsräte im Spannungsfeld zwischen Ausschreibung und Direktvergabe im ÖPNV

Abstract

Die Betriebsräte im öffentlichen Personennahverkehr (ÖPNV) sehen sich erheblichen Herausforderungen aus der ab 3. Dezember 2009 wirksam werdenden EG-Verordnung gegenüber. Die Vergabe von Verkehrsleistungen ist an die Alternative von Ausschreibungen oder Direktvergaben gebunden, nachdem eine über zehnjährige kontroverse Diskussion unter der Zielsetzung des von der EG/EU-Kommission angestrebten Ausschreibungs-Wettbewerbs beendet ist. In diesem Zeitraum sind im Bundesland Hessen bereits Schritte unternommen worden, um die Ausschreibung als einzigen Weg vorzugeben. In ganz Deutschland mussten sich die Betriebsräte der ÖPNV-Unternehmen der Diskussion und der Entscheidung über Ausschreibungen oder Direktvergaben stellen. Am Beispiel der Verkehrsgesellschaft Frankfurt am Main mbH (VGF), deren Busverkehre ausgeschrieben worden sind, im Verhältnis zu zwei anderen Unternehmen, der Bochum-Gelsenkirchener Straßenbahnen AG (Bogestra) und der Stuttgarter Straßenbahnen AG (SSB), mit Direktvergabe, wird dargestellt, welche Rolle die Betriebsräte gespielt haben. Aus den Ergebnissen können Handlungsmöglichkeiten für andere Unternehmen abgeleitet werden.
