Teoria dell’impresa e responsabilità parapenale: le implicazioni organizzativo-gestionali

Abstract

Questo lavoro ha lo scopo di offrire una lettura multidisciplinare del decreto legislativo 8 giugno 2001 n.231, che, come è noto, ha introdotto il regime della responsabilità amministrativa per la persona giuridica- impresa in caso di commissione di reati. Si proverà ad esaminare le disposizioni del decreto attraverso un approccio che sia debitore dei contributi dell’economia dell’organizzazione e della teoria dell’organizzazione aziendale, accanto a quelli del diritto. L’idea è di considerare l’organizzazione (paradigmaticamente l’impresa) il fenomeno da leggere attraverso linguaggi differenti. Uno studio “poliglotta” prova ad offrire interpretazioni e soluzioni multidisciplinari accessibili a chiunque. Il metodo utilizzato mira a cercare mediazioni anziché primati tra i diversi contributi teorici: esso sembra essere l’unico modo per offrire una visione a tutto campo di un problema, anziché una semplice (non meno importante) lettura di settore.
