Abstract

The paper commented on the points of the joint Resolution of the Plenum of the Supreme Court and the Supreme Arbitration Court of the Russian Federation of 29.04.2010 ¹ 10/22 «On some issues arising in judicial practice in the resolution of disputes relating to the protection of property rights and other proprietary rights" and the resolution of the Plenum Russian Federation of 04.04.2014 ¹ 22 "On some issues the award to the collector of funds for non-enforcement of the act." On the legal positions expressed in abstract explanations, the author tried to look from the perspective of how they were understood in the jurisprudence, which of the positions will remain relevant after the reform of the Civil Code and the abolition of the Supreme Arbitration Court of the Russian Federation.
