Riesgo político y riesgo regulatorio: problemas en la concesión de sectores de infraestructura

Abstract

Los riesgos políticos y regulatorios dañan tanto a los países como a los inversores al disminuir inversiones, o cuando estas tienen lugar, al aumentar el precio de los servicios. El presente trabajo tiene como objetivos caracterizar teóricamente los problemas de riesgo político y riesgo regulatorio, estudiar las medidas existentes de riesgo político y riesgo regulatorio, conocer los instrumentos disponibles para hacerles frente y extraer conclusiones de índole general sobre riesgo político y regulatorio, y de carácter particular, referidos a las concesiones de infraestructura. El trabajo se limita a estudiar riesgo político y regulatorio cuando el causante es el gobierno: no se analizan conductas oportunistas de las empresas.
