Abstract

Резюме: В доклада се разглежда въпросът за децентрализацията в държавното управление. Кои са органите, чрез които се децентрализира държавната валст, какви са техните функции и правомощия в това отношение. Територията на Република България се дели на общини и области (чл.135, ал.1, пр.1 от Конституцията). Според чл. 68 от ЗМСМА (ДВ 77/91г.), областта е административно-териториална единица, в която се децентрализира държавната власт с оглед провеждането на ефективна регионална политика. По-късно този текст на закона беше отменен (ДВ, 130/98 г.). В литературата е оспорвана позицията, че областта е административно-териториална единица, в която се децентрализира държавната власт. Това твърдение обаче не е безспорно, имайки предвид трайната практика на Конституционния съд.
