Abstract

On 17 December 2013, in accordance with the procedure introduced by the Treaty of Lisbon (Article 294 TFEU) involving the Parliament, the Council and the Commission, the Common Agricultural Policy has been defined until 2020. In particular, Regulation (EU) No 1307 / 2013 establishes rules on direct payments to farmers, Reg. 1305/2013 support for rural development by the European Agricultural Fund for Rural Development (EAFRD), while Regulation 1308/2013 governs the Common Market Organization agricultural products, single legal framework for the internal market, trade with third countries, competition rules. Direct payments confirm the decoupling of income support, with seven selective components, three of which are mandatory, such as basic payment, up to a maximum of 70% of the aid, greening (up to 30%), young farmers (max 2%). Other options: redistributive payment for the first hectares (max 30%), for less-favored areas (max 5%), small farmers (max 10%), coupled with strategic productions (up to 15%). The legislator continued the path already outlined in the single payment, with the aim of achieving greater specification and distributive fairness of prizes while leaving the individual states free choice on individual types of aid. The objective is to uniform the unitary aid between the different states (external convergence) and within the individual nations (internal convergence) over time. In practice, it comes to a highly personalized, potentially differentiated aid system for each European farmer. For each state, a national ceiling is to be set up on which to split the aid. Two important novelties, aid subjects, are the active farmer, defined by difference with respect to those who can not be (black list), with the aim of eliminating those who are not part of the agricultural world. The object of the aid (eligible area) is the entire area of ​​the enterprise, including permanent meadows and pastures, thus implementing the plan to reward the entire rural area.
