Abstract

Islam clearly commands the keeping of the soul also is closely linked to guaranteeing the rights of human life entirely without exception. So that in the event of trafficking of body organs from kidnap victims can result in rapid and deliberate buying laws, where the organs that are forcibly removed no consent from the owner and performed illegally can also endanger the health of even the owner and life of the recipient of the organ, because of the lack of regular supervision and health in the sale of black market organs. Interestingly, both islamic law and health measures go hand in hand in the prevention of organ buying practices, particularly the highly dynamic islamic syarial law to be followed in various human developments. The method thus employed was the legal istinbath method, in other words that each law istinbath was based on wealth. The study of clerical controversy over the buying and selling of body organs suggests that it is forbidden or sulfured under various provisions. Reasons for not letting him buy organs as god ennobling men in the surah of al-isra 'verse 70.
