Abstract

Melihat dalam perspektif keberadaan kelembagaan adat dan hukum adat dalam kesehariannya merupakan bentuk keaslian dari masyarakat setempat yang memiliki asas gotong royong (partisipasi) karena didasarkan atas kebutuhan bersama. Nilai-nilai gotong royong dan semangat kebersamaan ini sesungguhnya merupakan padanan dari cita-cita masyarakat desa yaitu demokrasi, partisipasi, transparansi, beradat dan saling menghormati perbedaan (keberagaman). Hukum Adat adalah wujud gagasan kebudayaan yang terdiri atas nilai-nilai budaya, norma, hukum, dan aturan-aturan yang satu dengan lainnya berkaitan menjadi suatu sistem dan memiliki sanksi riil yang sangat kuat.
