Die Wettbewerbskommission und die UBS : Was bleibt von den Auflagen ?

Abstract

Ziel dieser Arbeit ist es zu untersuchen, inwiefern es der Wettbewerbskommission (Weko) gelungen ist mit ihren Auflagen im UBS-Fall den Wettbewerb im Schweizer Bankengeschäft zu stärken. Wir kommen zum Schluss, dass die Weko ihre Auflagen so lange den Vorstellungen der UBS angepasst hat, bis sie von einer wettbewerbsfördernden Wirkung nicht mehr die Rede sein kann. Wenn die Schweiz eine schlagkräftige Wettbewerbsbehörde haben will, so muss dafür gesorgt werden, dass ein Grossteil der Interessenvertreter in der Weko durch kompetente unabhängige Experten ersetzt wird.
