Der Einsatz und die Bewertung von Rückzahlungsklauseln für Weiterbildungsmaßnahmen durch Unternehmen - Ergebnisse einer empirischen Untersuchung

Abstract

Unternehmen können Rückzahlungsklauseln einsetzen, um das Investitionsrisiko bei arbeitgeberseitig finanzierten Weiterbildungsmaßnahmen zu steuern. Allerdings sollte, so theoretische Überlegungen, der Einsatz diese Instrumentes von der Ausprägung einiger Faktoren des personalpolitischen und arbeitsjuristischen Kontextes abhängen. Im Beitrag werden zunächst theoretische Hypothesen zum Einsatz von Rückzahlungsklauseln im personalpolitischen und arbeitsjuristischen Kontext vorgestellt, bevor diese dann auf der Basis eines eigenen Datensatzes anhand von Modellen der logistischen Regression überprüft werden. Der starke Einfluss der Humankapitaltransferierbarkeit auf den Einsatz von Rückzahlungsklauseln bestätigt sich dabei. Zudem wird deutlich, dass das Investitionsrisiko in der Sichtweise der Arbeitgeber offenbar stärker von der absoluten Höhe der vom Arbeitgeber getragenen Kosten abhängt als von der Fluktuationsrate.
