A Defesa Comercial dos BICs (Brasil, Índia, e China): Algumas Lições Para a Política Brasileira

Abstract

O objetivo do presente artigo é analisar a Política de Defesa Comercial dos BICs (Brasil, Índia e China) nos últimos 15 anos, destacando semelhanças e contrastes. Após exame dos principais elementos da regulação dos instrumentos de defesa, como apresentados no Acordo Geral de Tarifas e Comércio (GATT) e na Organização Mundial do Comércio (OMC), é avaliada a evolução das investigações iniciadas e das medidas aplicadas para cada um dos parceiros dos BICs. Tendo em vista a importância das decisões do mecanismo de solução de controvérsias na área, são também examinados os principais painéis em que os BICs atuam como demandantes ou demandados. O artigo é concluído com algumas implicações da análise da defesa comercial dos BICs para a Política de Defesa Comercial do Brasil, no momento em que a indústria brasileira enfrenta sérios desafios. The objective of the present paper is to analyze the Trade Defence Policy of the BICs, in the last 15 years, with emphasis to similarities and contrasts. The paper starts with the exam of the main issues of trade defence regulation as established in the GATT and the WTO. Then it moves to the evolution of initiations and application of measures for each of the BICs. Considering the importance of the Appellate Body decisions in the Dispute Settlement Mechanism, the paper examines the main panels in the area having BICs as complainants or defendants. The paper concludes with some implications of this analysis to the Trade Defence Policy of Brazil.
