Direito ao Trabalho: Considerações Gerais e Preliminares

Abstract

A ideia do trabalho como direito está presente do debate público desde pelo menos o início da era contemporânea - e de maneira imbricada com a discussão dos direitos humanos. Ademais, ao longo do tempo, o direito ao trabalho transmutou-se no direito ao trabalho decente, com todas as características atribuídas a este último. No Brasil, o direito ao trabalho encontra-se consagrado na Constituição Federal de 1988 (CF/88). Todavia, a ênfase da CF/88 ao tratar do direito ao trabalho encontra-se na modalidade assalariada, restringindo o debate acerca deste direito. Grupos relevantes da população, que não se encontram nesta modalidade ocupacional, ficam à margem desse debate. Grupos como os conta própria, os cooperativados, os que trabalham em regime de economia familiar e os desempregados. Aliás, a situação destes últimos é definidora do próprio direito ao trabalho, que se concretiza por meio da supressão do desemprego. Seja qual for sua natureza, o desemprego não tem lugar em uma sociedade que postula o direito ao trabalho. The idea of work as a right has been in public debate since the beginning of the contemporary era - and so, intertwined with the discussion of human rights. Over time, the right to work has transmuted in the right to decent work, with all the characteristics ascribed to the latter. In Brazil, the right to work is enshrined in the Constitution of 1988. However, the emphasis of the Constitution is almost only in the wage employment. Therefore, the debate about the right to work has been restricted. Relevant groups of the population which are not engaged in wage employment sit on the sidelines of this debate. Groups such as self-employed workers, cooperative members, household workers and the unemployed. Moreover, the situation of the latter is defining of the right to work, which is realized through the elimination of unemployment. Whatever its nature, unemployment has no place in a society that assumes the right to work.
