Abstract

Este estudo tem por objetivo analisar a evolução do desenvolvimento tecnológico no Brasil, considerando os impactos da atual Lei de Propriedade Industrial na propensão a patentear de empresas brasileiras. Após discussão sobre a questão da propriedade intelectual em âmbito internacional e nacional, serão analisadas estatísticas do patenteamento no Brasil, com base na entrada em vigor da atual Lei de Propriedade Industrial e na origem de capital das empresas. Testes estatísticos serão aplicados com o objetivo de identificar a importância da origem de capital na propensão a patentear de empresas brasileiras e de verificar como esta propensão foi impactada com a mudança na legislação de patentes ocorrida em 1996. This paper analyzes the evolution of technological development in Brazil, considering the impacts of the Brazilian Intellectual Property Law, introduced in 1996, in Brazilian enterprises` patenting. Firstly, the paper presents the main debates about intellectual property rights. Then, it analyses statistics of patents fillings in Brazil. Finally, statistical models indentify the importance of the origin of capital in patentability in Brazil, and how the patentability was affected by legislation change in 1996.
