Análisis Empírico de la Eficiencia y el Uso Racional de las Salidas del Nuevo Proceso Penal Chileno

Abstract

La Reforma Procesal Penal iniciada en Chile el año 2000 entrega salidas al proceso que no existían en el antiguo ordenamiento legal. Este trabajo analiza empíricamente los determinantes de cuatro de estas nuevas salidas a las que pueden optar los fiscales: Acuerdos Reparatorios, Suspensión Condicional del Procedimiento, Archivo Provisional y Principio de Oportunidad. Los determinantes estudiados son: calidad jurídica de la víctima, edad del imputado, existencia de especies asociadas al caso, si se conoce o no al imputado, si éste tiene o no antecedentes penales y si existen testigos. Se utiliza información del Sistema de Apoyo de los Fiscales que contiene los delitos terminados al año 2010 en las cuatro Fiscalías Regionales de la Región Metropolitana. Se encuentra que las salidas del nuevo proceso penal se relacionan fundamentalmente con categorías de delitos de baja complejidad, lo que lleva a ahorrar recursos al sistema en su globalidad, evitando incursionar en casos respecto de los cuales no existe expectativa razonable de éxito. La racionalidad en el uso de estas medidas, y así su eficiencia, se prueba al encontrar que las variables de control seleccionadas son en general significativas para cada una de las regresiones.
