Abstract

né aux États-Unis sous l'influence de l'école néoclassique, le New public management (NPM) - ou nouvelle gestion publique - imprègne les politiques publiques en France depuis le milieu des années 1990, en rupture avec la conception de l'État-providence. Depuis la loi du 2 janvier 2002, le cadre juridique de régulation du secteur social et médico-social illustre cette inflexion forte des politiques sociales, par l'articulation des mécanismes contenus dans le Livre III du Code de l'action sociale des familles. Pour saisir l'ambivalence de ces instruments et comprendre les causes du paradoxe entre libéralisation et reconcentration des pouvoirs au niveau de l'État, il est utile de rappeler la genèse du NPM, les circonstances qui ont présidé à son adoption dans notre pays et ses conséquences pour les établissements et services sociaux et médico-sociaux.
