Les enjeux de la régulation des infrastructures : faut-il dégrouper la fibre optique ?

Abstract

En France, plusieurs opérateurs haut débit ont récemment annoncé des projets de déploiement de réseaux d'accès en fibre optique. Des investissements de cette ampleur comportent des risques inhérents à l'activité elle-même, mais aussi à son environnement juridique et réglementaire. Les pouvoirs publics, et surtout le régulateur sectoriel, se trouvent face à une situation complexe : d'un côté, des investisseurs privés désireux de déployer puis de rentabiliser des réseaux très haut débit, de l'autre, une probabilité non nulle de voir se reformer des structures monopolistiques, au moins au niveau local. Comment gérer cette opposition entre le souci d'inciter les opérateurs à l'investissement, source d'innovation, et le maintien d'un tissu concurrentiel ? L'objet de cet article est de fournir quelques pistes de réflexion pour essayer de répondre à cette question. En particulier, nous discutons différentes formes d'intervention des autorités publiques : partage des infrastructures, investissements des collectivités locales, séparation fonctionnelle ou structurelle. Nous abordons également le problème du basculement des clients servis actuellement par le réseau cuivre historique vers les nouveaux réseaux d'accès.
