Abstract

Developed as part of the Mondes de Production published in 1993 by Robert Salais and Michael Storper, the convention of the State concept can be mobilised to develop a reflection on European policy, as Robert Salais did in 2015 in the Revue Française de Socio-Economie. This contribution analyses through this prism the historical dynamics of the construction and implementation of E.U. competition laws. It focuses on the influence of ordoliberalism and puts it in perspective with the effects-based approach. Finally, it concludes with the inflections that can be observed in E.U. decision-making practice through concerns related to fairness or to contractual unbalances between trading-partners
