Contrefaçon de marque : De quoi parle-t-on ? Comment s’en protéger ?

Abstract

La première étape de la vie d'une marque est sa création. Le droit des marques va offrir à l'entreprise, dans le choix de sa marque, un ensemble de signes qui vont lui permettre de définir sa stratégie de communication. Cela étant, tout au long de sa vie, la marque est susceptible d'être victime de contrefaçon. Celle-ci, véritable fléau commercial, doit être combattue dans le cadre d'une veille concurrentielle permanente. L'entreprise doit en conséquence avoir connaissance de toutes les formes d'atteintes qui peuvent être portées à sa marque et de tous les outils juridiques qui lui permettent de s'en protéger.
