Abstract

Amartya Sen's « capability approach » makes strong consensus among theorists and practitioners of social sciences. Nevertheless it seems that general consistency of this approach is not self-evident and that all public policies it may justify are not well ordered. Therefore we justify the idea that Sen's uncontestable contribution – the substitution of "capabilities" to "resources" - would be more fruitful and more valued, if it were left "embedded" in the general and hierarchized framework of John Rawls' theory of justice. As a consequence, we can wonder whether the basic distinction, that Sen recently suggested, between "transcendental" and "comparative" approaches of social justice is useful, whereas that distinction makes his criticism against "rawlsian" theory even more radical.
