La libéralisation des structures d'exercice de la profession d'avocat: une perspective d'économie industrielle

Abstract

L'ouverture du capital des structures d'exercice de la profession d'avocat et le développement de sociétés multi professionnelles constituent deux des évolutions majeures accélérées par la Loi dite Macron de 2015. Cette contribution se propose de lire celles-ci à la lumière de l'économie industrielle afin d'en mettre en exergue les enjeux, les gains espérés mais aussi les possibles risques. A cette fin, elle s'appuie, dans une visée comparative, sur les politiques suivies au Royaume-Uni et aux Etats-Unis.
