L’Éthique À L’Épreuve De La Gestation Pour Autrui (Gpa)

Abstract

Le 17 janvier 2018 se sont ouverts les états-généraux sur la bioéthique. Parmi les questions abordées, la Procréation Médicale Assistée (PMA) et la Gestation pour Autrui (GPA). Cette dernière, en particulier, fait l'objet de très vifs débats dans la presse. On lui reproche notamment de réifier ou de marchandiser le corps humain 1. D'autres avancent, au contraire, que la GPA – correctement encadrée – constituerait une avancée sociale importante, reconnaissant ainsi la diversité des modèles familiaux 2. Certains y voient l'apanage du néo-libéralisme, d'autres – au contraire – une forme de collaboration sociale. L'objet de cet article est de s'interroger sur la légitimité morale d'une loi autorisant la GPA en France aujourd'hui. Notre questionnement sera strictement éthique. Au-delà de toute conclusion, si conclusion il y a, l'enjeu est également d'évaluer la capacité de nos théories éthiques à répondre à des enjeux inédits tels que celui-ci.
