Abstract

La publication de l'ouvrage Virtual Competition d'Ariel Ezrachi et Maurice Stucke en 2016 a renouvelé les questionnements sur la possibilité de voir des algorithmes devenir des vecteurs de pratiques anticoncurrentielles voire, dans certains cas, de véritables inducteurs de celles-ci. Après la publication de nombreux rapports ou enquêtes sectorielles de la part de la Commission européenne, de l'Autorité de la concurrence, du Bundeskartellamt ou encore de l'OCDE, les algorithmes sont mis en cause dans de nombreuses procédures concurrentielles. Nous proposons de jauger ces cas et d'envisager d'autres pratiques possibles à l'aune de l'économie industrielle. Si certains des risques concurrentiels peuvent apparaître comme inédits, ils apparaissent en grande partie comme déjà connus en droit et économie de la concurrence.
