Abstract

Les procédures transactionnelles sont de plus en plus utilisées par les autorités de régulation sur la base des gains d'efficacité qui sont espérés de ces dernières non seulement en termes procéduraux mais également en termes d'effets sur le fonctionnement des marchés régulés. Nous nous attachons dans cette contribution au cas de la composition administrative mise en œuvre par l'Autorité des Marchés Financiers française. Nous mettons la pratique de celle-ci en perspective avec les enseignements qu'il est possible de tirer des recours à des procédures comparables par les régulateurs financiers étrangers, principalement les Etats-Unis, et par d'autres autorités sectorielles, en l'espèce l'Autorité de la concurrence .
