Abstract

Les récentes ordonnances voulues par Emmanuel Macron ont opéré de profonds changements dans le droit du travail français. Plus précisément, la troisième ordonnance de la rentrée gouvernementale a institué un encadrement des indemnités prud'homales pour les salarié.e.s en cas de licenciement. Cette réforme se fixe pour objectif de renforcer la prévision des décisions prud'homales, considérées par les fédérations patronales comme trop incertaines. Elle chercherait également à favoriser le développement des plus petites entreprises en limitant leur risque juridique. Certain.e.s reprochent néanmoins à ces dispositions leur éventuel parti pris en faveur des dirigeant.e.s d'entreprise, au détriment des employé.e.s qui subissent potentiellement de lourds préjudices en cas de licenciement, lesquels devraient être évalués de manière individualisée. Cette conférence ouverte au public a réuni trois intervenant.e.s pour discuter de la pertinence ainsi que des effets escomptés de l'encadrement des indemnités prud'homales. L'objectif était de fournir des regards croisés entre économistes, juristes, et praticiens du droit.
