L'équité dans le financement du système d'indemnisation : quelques éléments de réflexion, beaucoup d'incertitudes

Abstract

L'analyse économique identifie au moins deux dimensions dans lesquelles un système assurantiel ou indemnitaire peut être évalué à l'aune de l'équité : - l'équité dans l'indemnisation (et dans les conditions de l'accès aux dispositifs) ; - l'équité dans le financement. La première dimension parle donc des victimes et cherche à savoir, en termes d'équité horizontale, si des victimes semblables sont traitées de manière comparable ; en termes d'équité verticale, si des différences de traitement sont justifiées par des différences de situation. La seconde dimension s'interroge sur la manière dont la charge de financement des différents dispositifs est répartie entre l'ensemble des membres de la société. Cette note présente une première analyse, très préliminaire, de cet aspect de l'équité. Compte tenu de la multiplicité des dispositifs à l'œuvre et de la diversité des sources à mobiliser pour une telle analyse, elle se contente de poser quelques pistes pour une étude plus complète qui reste à entreprendre.
