Abstract

La loi n° 2007-1774 du 17 décembre 2007 portant diverses dispositions d'adaptation au droit communautaire dans les domaines économique et financier prévoit, notamment, une demande d'autorisation du gouvernement d'agir par voie d'ordonnance pour moderniser les règles juridiques applicables à la titrisation. Il semble qu'il est question de contractualiser davantage le mécanisme actuel tout en veillant à sa sécurisation. Son articulation avec les règles de droit international et son ajustement avec la technique de la fiducie récemment introduite en droit français devraient également être améliorés. Il s'agit enfin de mieux encadrer la titrisation des risques d'assurance.
