Abstract

La question de l'incidence du temps dans l'évaluation des préjudices est évoquée de deux manières différentes dans la loi :soit il s'agit d'indemniser le retard dans le paiement d'une dette de somme dont le montant est d'ores et déjà déterminé sans que le juge ait à intervenir et qui est exigible après mise en demeure du créancier ;soit il s'agit d'une situation dans laquelle c'est le juge qui va décider de la somme d'argent qui doit être allouée au créancier, notamment dans le domaine de la responsabilité (contractuelle ou extra contractuelle).Cette somme pourra comprendre en plus des intérêts moratoires, des intérêts qui vont naître avant la date du jugement pour compenser les effets du passage du temps entre la date des faits préjudiciables et la date du jugement.
