Abstract

L'évaluation des préjudices économiques s'appuie sur une démarche économique et financière. Elle comprend à la fois l'analyse du passé et des attentes sur le futur et consiste à comparer la situation réelle avec la situation normale ou contrefactuelle afin de déterminer les pertes subies et le manque à gagner. Sa détermination relève de l'expertise mais doit être validée par le juge qui seul peut décider de ce qui pouvait être légitimement espéré.
