Abstract

Le recours aux prêts d'actionnaires pour financer un investissement porté par une filiale est devenu, en quelques années, un réflexe pavlovien, dans la mesure où il peut non seulement faciliter la levée de fonds complémentaires auprès d'un banquier tiers mais également d'améliorer significativement le rendement attendu de l'actif financé. La sécurisation fiscale de ces schémas de financement et des charges financières intragroupes en résultant, complexes à maîtriser dans leur quantum et principe de déductibilité, constitue désormais un enjeu stratégique.
