Organisation De La Gendarmerie Départementale À L'Aune De La Directive Européenne Sur Le Temps De Travail, Décision Du Conseil D'État

Abstract

Sur ce sujet du temps de travail, le chef de l'État souhait qu'aussi bien la gendarmerie que les militaires de manière plus générale, ne soient pas concernés par la directive 2003/88/CE du 4 novembre 2003 du Parlement européen et du Conseil concernant certains aspects de l'aménagement du temps de travail.. Pour autant, la « mise au pas européenne » 7 a bien eu lieu avec la décision de la Cour de justice de l'Union européenne (CJUE) en date du 15 juillet 2021. Dans la continuité de cette décision, le Conseil d'État s'est prononcé, dans l'espèce chroniquée, sur l'applicabilité de la directive à la gendarmerie départementale.
