Abstract

Depuis 2010, au titre de son obligation générale de sécurité, l'employeur doit prévenir les risques professionnels, parmi lesquels les facteurs de pénibilité. La notion de « pénibilité » fait partie de celles « dont on pressent le contenu et l'importance sans pour autant parvenir à les définir avec netteté, notamment d'un point de vue juridique » (Verkindt, 2018, p. 42). Certains pays de l'OCDE l'ont appréhendé à partir de l'appartenance à un métier combinée à une liste de conditions de travail potentiellement dangereuses (OCDE, 2011).
