Abstract

De tout temps, les banques et les institutions financières ont fait faillite ! Pour autant, ce phénomène s'est accéléré avec la crise de 2008 et la faillite de Lehman Brothers, lesquelles ont démontré la fragilité de ce secteur. Nombreux, en effet, ont été les établissements ébranlés, en réelles difficultés ou même en faillite pendant cette période, tandis que d'autres n'ont trouvé leur salut que grâce à une restructuration financière largement soutenue par un effort national. Mais à chaque fois que la défaillance d'un établissement de crédit est pressentie ou avérée, force est d'observer que les législateurs français, d'abord, et européen, ensuite, s'inquiètent de la protection et de l'indemnisation des clients déposants. De cette préoccupation est né un droit des défaillances bancaires. Peu à peu, un corps de règles a ainsi été défini pour régir spécifiquement l'hypothèse de la faillite des banques et établissements assimilés. Il en est de même des entreprises d'assurance en difficulté
