Tierce-opposition et défaut d’intérêt à agir de celui auquel la qualité de créancier n’a pas été retenue

Abstract

Il résulte de la combinaison des articles L. 661-3 du code de commerce et 583, alinéa 2, du code de procédure civile que si tout créancier invoquant des moyens qui lui sont propres ou démontrant que le jugement a été rendu en fraude de ses droits a qualité pour former tierce opposition du jugement modifiant le plan de sauvegarde, il doit en outre justifier d'un intérêt personnel à exercer cette voie de recours. Tel n'est pas le cas de celui dont la qualité de créancier n'a pas été retenue après que la cession de créances dont il tenait ses droits ait été résolue. N'étant plus créancier de la société débitrice, il devient sans intérêt à critiquer le plan modifié.
