Abstract

Dans l'analyse économique du droit, la notion d'efficience est centrale, son objectif premier est de fournir un moyen d'évaluation des effets du droit sur le bien être social, compte tenu du fait que les changements peuvent améliorer la situation de quelques-uns et détériorer celle de quelques autres (Kirat, 1999). Sans entrer dans les détails qui seraient plus économiques que juridiques, je souhaite ici m'interroger sur la différence entre la volonté du législateur, garant de la demande sociale, et l'application réelle de la loi qui se met en œuvre après un certain nombre de négociations. De manière différente il s'agit de bien connaître la teneur première des vœux du législateur puis de les comparer avec les modalités pratiques d'application pour enfin pouvoir apprécier son efficacité eu égard des objectifs. Une première approche centrera mon propos sur la loi d'orientation agricole et principalement sur les CTE (contexte général et objectifs) dans un deuxième temps j'examinerai les points sujets à controverses, enfin et pour conclure j'aborderai le sujet sous l'angle de l'évaluation.
