The Amoco-Cadiz affair : appraisal and compensation for damages

Abstract

Cet article analyse le coût social de la marée noire entrainée par le naufrage du pétrolier Amoco-Cadiz. L'évaluation des dommages est envisagée du double point de vue des principes économiques et de leur mise en œuvre. On fait une distinction entre les dommages monétaires et les dommages non-monétaires. Les premiers concernent principalement les opérations de nettoyage et les pertes des entreprises privées (hôtels, pécheurs, ostréiculteurs) tandis que les seconds se référent aux couts d'opportunité subis par les entreprises et aux pertes d'aménité des touristes et des résidents. De plus on discute la question des pertes écologiques en insistant sur une méthode d'évaluation fondée sur la chaine trophique. En conclusion le tribunal ne prend pas en compte l'ensemble du coût social. Ainsi cet article essaie d'établir un pont entre des approches diverses émanant des scientifiques, des économistes et des juristes.
