Abstract

La transmission de l'exploitation familiale à un successeur étranger à la famille, bien que n'étant pas majoritaire, a toujours eu lieu. Etudiant le cas d'installation en société on s'aperçoit que les partenaires, au lieu de se référer à une logique professionnelle de l'échange lié à leur contrat, entretiennent des relations de type familial faisant parfois penser à un processus d'adoption. Des tensions peuvent se développer du côté du candidat qui vit mal les règles d'une famille autre que la sienne, et aussi du côté du cédant ou du partenaire restant habité par une vision patrimoniale de son entreprise qu'il cherche à faire partager par son associé.
