Abstract

La relation du droit et du fait contient à la fois la majeure partie des réflexions sur la théorie générale du droit et des critiques usuelles contre telle règle particulière, jugée excessive ou insuffisante. L'analyse empirique du droit rural français conduit à considérer la relation du droit au fait selon un rapport plus complexe, où la règle juridique n'est pas seulement un instrument de l'allocation ou de la répartition des richesses et ne doit pas être appréciée en fonction de son unité ou de son efficacité. Le droit dans un pays fort peu juridique comme la France est la forme la plus solennelle du discours politique, destiné à donner au pouvoir l'occasion de renvoyer à la société une image vertueuse d'elle-même. Loin de permettre d'agir sur les faits, il les décrit avec des tabous et des mythes, exprime des représentations sociales ou des certitudes scientifiques et parvient à faire naître des faits plus qu'à les organiser par une norme.
