Поєднання Боржника І Кредитора В Одній Особі Як Правоприпиняючий Юридичний Факт У Зобов'Язальній Сфері

Abstract

Стаття 606 Цивільного кодексу України встановлює, що зобов'язання припиняється поєднанням боржника і кредитора в одній особі. При поєднанні боржника і кредитора в одній особі як правоприпиняючого юридичного факту, правовідношення зазнає наступних змін. Одна особа переймає на себе всі юридичні властивості іншої у правовідносинах у зв'язку з чим припиняє статус учасника правовідносин її контрагента. Всі юридичні зв'язки рівною мірою як і об'єкт правовідносин поглинаються особою, яка поєднала в собі двох (або більше) учасників цивільних правовідносин. Учасник правовідносин, який є контрагентом особи, яка поєднала в собі боржника і кредитора за зобов'язанням перестає бути суб'єктом цих конкретних правовідносин але залишається бути суб'єктом права в силу того, що він продовжує існувати і здатен мати права і обов'язки. Зобов'язання у разі об'єднання боржника і кредитора в одній особі припиняється у зв'язку з тим, що одна особа не може одночасно бути і боржником і кредитором в одних правовідносинах. Поєднання боржника і кредитора в одній особі, поєднує зміст правовідношення, який розділений між кредитором і боржником у формі прав і кореспондуючим їм обов'язкам у одного учасника правовідносин внаслідок чого, форма правовідношення також зазнає таких видозмін, які унеможливлюють її існування.
