Класифікація Правоприпиняючих Юридичних Фактів

Abstract

Класифікація юридичних фактів є певним кроком у пізнанні багатоманіття явищ, що мають значення для права. Проте, акти цивільного законодавства України не містять будь-якої чіткої класифікації юридичних фактів за тими чи іншими ознаками. Не вказані в них і критерії для таких класифікацій. Вчені здійснюють класифікацію юридичних фактів на підставі різних ознак. Зокрема, найбільш розповсюдженими є класифікації за: а) волею суб'єкта; б) юридичними наслідками; в) за формою прояву; г) за завершеністю тих чи інших явищ. Вважаємо, що для виявлення місця правоприпиняючих юридичних фактів у системі юридичних слід визначити таку властивість останніх як можливість викликання настання тих чи інших юридичних наслідків, адже в саму назву «правоприпиняючий юридичний факт» покладено принцип викликання наслідку у вигляді припинення права. Залежно від характеру наслідків юридичні факти поділяються на: 1) такі, що встановлюють право. З їх існуванням пов'язане виникнення правовідносин; 2) такі, що змінюють право. Наявність цих фактів спричиняє зміну правовідносин, що вже існують; 3) такі, що припиняють право. Це такі обставини, наявність яких призводить до припинення правовідносин, що вже існують; 4) такі, що перешкоджають виникненню або трансформації права. Це обставини, наявність яких зумовлює правову неможливість виникнення, зміни припинення тощо правовідносин. 5) такі, що поновлюють право. До них належать обставини, наявність яких спричиняє поновлення прав, що існували раніше.
