Abstract

Право як явище соціальної дійсності упорядковує суспільні відносини, створює умови для задоволення потреб кожного їх учасника, що досягається за посередництвом правового регулювання цивільних відносин. Правове регулювання цивільних відносин – це об'єктивний вплив на громадські відносини за допомогою правового інструментарію в світлі досягнення обґрунтованої мети, яка є формулою вираження узгодженого інтересу членів суспільства. Розглядаючи правове регулювання суспільних відносин в динаміці, варто зазначити, що закономірним є факт спочатку виникнення суспільних відносин, а вже потім, санкціонування чи закріплення норм права, наданням їм статусу правових. С. С. Алексєєв визначав три стадії правового регулювання: а) стадія регламентування суспільних відносин, що потребують правового опосередкування; б) стадія дії юридичних норм, у результаті яких виникають чи припиняються правові відносини (суб'єктивні юридичні права та обов'язки конкретних осіб); в) реалізація суб'єктивних юридичних прав та обов'язків. Чи витримала теорія видатного вченого перевірку часом? Відповідь на це не просте питання спробуємо дати статті.
